Post: Obtaining Writ from County Court

Our tenants appealed the decision in JP court then paid 1 months rent into the registry. They will need to pay another month into registry before the court date. What happens if they don't pay? I've been told that even if they don't pay, we can't get Writ of possession from county court. Does anyone have experience on this?

Also what happens if they don't file answer?

Do yourself a favor: buy "Every Landlord's Legal Guide" by NOLO. Written by attorney investors, it's full of practical advice pertaining to management of investment property, has sample forms that can be edited, and - most importantly - they tell you what your primary state laws are and where you can read them. It's updated every year and is the best $40 you'll spend as a Landlord. There is one book for 49 states and a separate book for California.

My tenants appealed the JP court ruling, so we have a county court date set up next month. In the meantime, I received possession of my house through a writ of possession. I was not planning on attending the county court date. Do you think this changes things? I don't know if my judgement from JP court still stands?

I like to err on the side of caution.  A judge kicked them out due to past due debts but I'd still send the itemized list including the judgement plus whatever else they owe.  If this was unnecessary you lost postage, if you missed this step how frustrating would it be to have to give a deposit back to a tenant that owes money based on a technicality if they took you to court.  


 This is my concern. She has just barely made every deadline to extend the eviction....I feel like she does this for a living. 🙄

We just evicted our tenants for non-payment. Do we have to send them an itemized list of charges to keep their security deposit?

Our tenant appealed the court decision but did not pay rent into the system. We received the writ and evicted them. Our county court date is set for a month. Am I allowed to rent my house out again? I cannot seem to find any information online regarding this.

There was an attempted robbery at our rental the other day. The guy threw a tile through the window,  but got spooked because the tenant was home. A police report was filed and the suspect has been found. 

I have to pay to fix the window. Is it even worth my time to go after the suspect or do I just take care of it and forget it? How would I even go about charging the suspect?

My tenant just informed me that he lost his job and has all his stuff out of the house. What steps am I legally required to go through? He hasn't paid July rent. Is there a form I can get him to sign or just a 3 day notice to vacate is sufficient?

He also said he left a table and chair that he doesn't plan on claiming. I guess I need to have him sign something to surrender these items also?

I am looking to replace our a/c system either before the end of the year or early in 2018. Are there any advantages to doing this before the end of the year? We are thinking that it will be advantageous to start amortizing it for 2017 taxes, but not a tax expert here. Any help is greatly appreciated.

She sent everything electronically, so that shouldn't have been an issue. I received her application with the same email address

If you can't verify that she isn't lying about income then you don't know that her income is.

We received an application to rent our house along with the application fee. I have asked for a copy of her DL and paystubs for 2 days now, and she keeps telling me that she sent them, she will resend them, etc. 

Is there a specific amount of time that I have to wait before I deny her? She meets the income requirement, but I can't verify it. I want to move on to the next applicant if I can, especially if this is a testimony to her character. I already ran her credit, but I'm willing to refund her application fee. How would I go about doing this?
