There are lenders in my area that are credit unions and they will permit an LLC refi at 75%-70% value, after an ownership seasoning period of 6-12 months, lender dependent.  Look along that avenue where you are.

Without being an attorney, I would argue that any current agreement is meaningless.  Only the executor has power to sell, and she cannot bind the sale of the property to you because she is not now the executor.

If not, is it in the name of a non-natural person?
If so, is the any lien/mortgage on the property at present?
On the borrowing end, what loan to value are you looking at?
