If the out going tenant puts multiple holes into the walls and therefore makes the property un-rent-able  until the holes are fixed, is the out going tenant responsible for the loss in rent income ( 1 month) and can it be deducted from the Damage deposit.

I am hoping that my tenants actually move out by March 31.  However I have little faith that they will be able to get their RV and fish house out by that date.  What are my options?

I am in a similar situation.  Just got out of court yesterday.  Judge statement was - Sorry for all of the problems that they caused you but you should have evicted them sooner.  Do not purchase the car from them - they will say you forced them into it even if you have a signed paper - they will say you force them to sign that.  You need to protect yourself.  I tried for 4 year to be the good guy and help a family and it did nothing but bite me in the A$$ both financially and mentally.  My tenants acted nice for the 4 years I went out of my way to help them and then turned into my worst nightmare once I could not take their BS anymore...  Lied and filed charges against me that I had to go to court to prove were bogus which cost money, time and mental health.  Court did see that they were lying but only through their case out after testimony and I still have to get rid of them...    March 31 / April 1 is going to be a party if they actually move...

It is not that easy if they file a bogus harassment lawsuit to keep you off of the property. Now you have to fight the lawsuit and try to evict them at the same time.

We did do an initial walk through and there was nothing noted - no damages.

I have not been able to get into the house to inspect it yet - they will not let me in the house  - but have hear that there are significant damages in the house.

The MN standard lease only states normal wear and tear vs excessive damage.

The large holes in the walls should be considered excessive but I was wondering if there was any kind of list that states what is normally considered excessive damages.

My first tenant is moving out and it is not going smoothly.

There seems to be a lot of excessive damage to the house and I want to know what is normally considered excessive damage.

Is there a standard listing of typical excessive damages in rental properties?

I am evicting a tenant and I know of holes in the walls 

Can I do the repairs and charge them a hourly rate 

If so what would be an acceptable rate for the repairs.

They also ripped the shelves off the refrigerator and I can not purchase a replacement door - can not find one.  Can I replace the refrigerator with a similar aged one and charge them for it?
