I live in Southern California, do I need to use the California RE contact to get a probate deal under contract to be able to assign it as a wholesale deal? Since these transaction are all cash, could I use a regular one to two page wholesale contract? Would the attorneys have problems using the 2 page contract? thanks.

Liens are the norm, not the exception.

It's rare that a PR knows much about the condition of title.

You should structure your offer anticipating liens or refer to people who know how to work these deals with liens. After your put together a couple of deals you'll know his to document with the risk on the seller of how to profit when the liens do show up.

When you say "structure your offer," do you mean to add an additional line to the contract to state that the seller is responsible for any and all outstanding liens, seconds, or taxes not previously mentioned in the initial offer?

 This has not happened to me, it came up during a title search but the liens were cleared. I just wanted to know for the next time. 

The best you can do is renegotiate the final sale price to cover the liens or back out of the deal if the numbers don't make sense.

 No, the buyer has a clause where he/she could back out for any reason.

Hi All, 

When having a probate deal (or any deal) under contract in a wholesaling transaction, what happens when the title company finds an unexpected lien or 2nd or taxes, etc on the house? Who pays the liens or taxes? I mentioned probate because many times the PR probably won't know all the financials on the house. Thanks!

Hi All!

Just came across BP today for the first time and it seems like there is a lot good information on this site. I was looking for some possible local coaching in various aspects of RE. I am not sure where to start but this site looks is a great start.

I am located in So. Cal (OC) and wanted to get some feedback from this community as to where to start looking for possible flipping, lease options, wholesaling, etc. I have bought and sold other properties but now I want to get into investing. Any guidance will be appreciated! Thanks!
