@Nicolas Nuvan honestly communication with them has been very difficult so haven’t really had much of an opportunity to negotiate. They didn’t seem interested with my original offer but I am meeting with them this weekend so I’ll be prepared to go higher.

@Bin Chen haha appreciate the honesty, but it’s weird I’m getting so much mixed info. Some people are saying like you that you can’t get people out period. Others (like my lawyer) are saying in my case with no lease I can get them out and he’s been doing a bunch of these. It just may take longer than in normal circumstances. Still hoping to just come to some sort of an agreement with the tenants but they’re not making it easy it we shall see. Appreciate the info!

Inherited a tenant in a new property in Brooklyn, NY which has proven to be a nightmare lol. They have lived in the property for years way under market rent without ever having a lease. After they refused to sign a lease, I had my lawyer serve a 90 day notice to vacate which then lead to further problems including them refusing to pay rent. According to my lawyer nothing can be done until the 90 days pass and then I could try to go after them for the unpaid rent. However, I was thinking that due to nonpayment the process could be sped up. I know that things have changed with covid so I was looking for some advice to how courts in the city are handling these issues. They haven't claimed any hadrdship due to covid although I know that wouldn't be difficult for them to claim. Any advice would really be appreciated, I also did try to cash for keys with no luck. Thanks in advance!

Hello all, I have a legal question for a property I’ve acquired with inherited tenants in Brooklyn. The property is a 2 family and both tenants have been in the property for over 10 years with no form of a written lease which to my knowledge places them legally as month to month tenants. They are severely below market and my plan is to present them with a written month to month agreement with an increase to bring them closer to market rents. My question is if they refuse the increase do I still have the option to terminate the tenancy given any legal changes due to COVID, and if I do how much notice is required? I’d obviously prefer not to take that route considering the times but I’d like to know my options going in. Also if anyone has a good landlord-tenant lawyer recommendation it would also be appreciated as this is my first property in the city.

I am currently looking to close on my first house back (2-3 family) in the Union City, West NY, North Bergen, etc areas. I’ve been searching for quite some time and putting in offers and even had one accepted to only have it fall out of escrow unfortunately. I’ve been working with an agent who seems pretty good and I honestly have no complaints however this process has taken longer than expected and I feel that I need to explore all my options. @Jonathan Greene that’s fair and I appreciate the perspective from another agent so thank you. However the reason I haven’t seen any properties as of yet is because he said that he would compile a list and send it and we would choose which ones we’d like to visit which he hasn’t done yet. In the meantime I also made a list of properties that I was interested in seeing and sent it to him and again waiting for his response. At my current position unfortunately I’m not at a place where I can promise him 10 properties a year, but if you have any other suggestions on how a new investor such as myself can provide value to an experienced agent I would appreciate it.
