Completely agree with you. I WILL NOT accept cash for keys. That is a short sighted approach. This type of behavior must go on peoples record. I will also be looking for long employment history for future tenants, as wage garnishment seems to be the only legitimate way to recoup any past rent.

I am a small landlord in upstate NY. I have been trying to evict a tenant since January 2019 Pre-COVID!!!she has not payed rent for 13 months! and now allowed to stay even longer. NYS won't even give me a hearing, they just keep postponing!  This is completely outrageous!! I don't understand why more landlords aren't outraged by this Eviction BAN!!! 

@Jeffrey Allen  NY will not hear ANY evictions....I understand that it is being portrayed very differently through media! This is exactly why I am wondering why more landlords are not outraged by this Eviction Ban?! Totally unconstitutional IMO

@John Underwood Ny will not hear ANY evictions. I understand that is what the news is saying, but that is not accurate! 

the Eviction was filed January 2019! PRE-COVID! They only have to prove hardship if they request an adjournment....she obviously doesn't need to request an adjournment when the government does it for her! 

@Jeff Willis yes even when we get a judgement, how does the government expect us to collect?! impossible! This hysteria about MASS EVICTIONS is a scandal that the government is creating and only making worse by kicking the can down the road!

To be clear: I am just as outraged with our government for incentivizing and Advertising the Eviction Ban as I am with this tenant that is Clearly able to at least make an attempt to pay rent but refuses to! 

I WILL be  doing everything I can to collect from this tenant years down the road if I have too..AND also collecting from the government through my Taxes. 

Cash for keys is completely out of the question IMO. That only promotes this entitlement mentality! 

@Mindy Jensen I am in upstate NY, I have heard the same, but my attorney has confirmed with me multiple times that the courts are postponing ALL evictions not just for non-payment. To be clear, this eviction started with this tenant before COVID...I filed in January 2019. clearly unrelated to COVID, however I still cannot get a hearing. OUTRAGEOUS!

I am a small landlord in upstate NY with 5 rentals. I was in the process of evicting a tenant in March when COVID happened. This tenant has not paid rent since December 2019! in three days it will be 13 months that I have not received rent!!  I am being told by the government, state & federal that there is nothing I can do. ********! This tenant is completely taking advantage of this. She is still working, multiple people in the house and yet they still won't pay a penny. I can't believe the government is doing this to us!! why not tell grocery stores they can't charge for food?! why not tell everyone that nobody has to pay for anything?! why are landlords being forced to pay this mortgage and still being told to pay property and school tax on time?! Why do I still need to keep utilities that I pay for on?!? I am outraged that this eviction ban was extended yet again. Are no other landlords in the same position I am?? What can we do???

@Christoper Smith Thankyou for the Info! I am hoping that there might be someway to claim it this year because of the extreme circumstances of having to keep a tenant that won't pay, when I should be able to evict and move forward to make a profit! As a small landlord being forced into paying 12 months of a mortgage, taxes, insurance, and maintaining the property is extremely difficult. 

@Daniel Hyman Thankyou for the info! yes I am baffled as to why this is not the main topic on threads, esp. with it most likely being extended even further!? Are landlords just not speaking up?? I don't understand how the government can tell me that I have to continue to pay for someone else to live in my house?! Why not tell grocery stores they have to provide free food as well? Is there a discussion going on about this that I don't know off? I have searched BP multiple times without finding to much info. 

Hi BP community, I am a small investor from upstate NY. I have 5 rental units, 1 a single family home and 2 two family homes that I rent.

I am Wondering how the math works when calculating a loss on one rental property against a profit on another rental property, Here is my scenario:

Single family home has not paid rent due to COVID and I cannot evict them. It has been a full 12 months I have not received rent. (eviction process was started before COVID happened and then the courts shut down) Tenant now owes me $14,400. Can I claim the full $14,400 as a loss on my taxes? or can I only claim my mortgage interest, taxes, insurance etc. for those 12 months as my loss? 

Additionally, if I show a profit of $5,000 of my other two properties which I would assume to pay about $1,000 in taxes on. is that $1,000 deducted from the $14,400 loss,  meaning I would really not pay any taxes on the $5,000 and would be left with $13,400 in a loss that I could deduct on future years on profit?

Any insight would be helpful!

I am very curious why I am not hearing many people talking about the ban on evictions and the loss of rent?! Is it because it's not really a loss if you have other properties and can get the tax deduction for future years? I have no hope in ever getting any money from the tenant, they are completely taking advantage of me and the COVID situation. hoping there is some other way to get that money back from the government.
