Hi all, 

Current tenant at our WA property has been nothing but a headache. He constantly fights, did not renew previous lease and that went into a month to month lease and reduced our options as a landlord. This year we paid a good amount to a lawyer and he prepared a "Termed lease agreement" and got it signed from the tenants. 

Its clearly stated in the lease that this is a termed lease and does not enter into month to month. Also that, landlord and tenant need to sign a new lease 70 days before the current lease is over. The landlord can terminate the lease by giving 60 days notice prior to the termination of the lease. 


I still have following questions given the fact that the washington state favor tenants generally speaking,

1. Based on this, if we give a termination notice 60 days prior to termination, will the tenants have to leave or is there any scenario in which they may still be allowed to stay?

2. I have noticed these tenants don't read anything. They may have missed these important facts in the lease. 2 months notice may catch them off-guard. Should I give them early enough notice like 4 months in advance so they get enough time to find another place?

3. are there any better ideas to let these tenants leave? Its been a nightmare to deal with them.

Post: Passive RE investment

Hi, 

We own a couple of homes in the country and have first hand seen how difficult it is to manage the rentals remotely. 

Now, we are looking into going the passive investment route. We like single family, apartment, multi-family type investments. But don't want to purchase and manage anymore. What are some less complicated ways to go about passive investment? Just started reading about the crowdfunding platforms like fundrise and crowdstreet. Are these platforms a way to go or are there any other ways?

Fine. Some of it is subjective to their rates so let’s keep that aside. 
for there lease draft - he did not share his draft with me. I sent him a list of clauses I like to see included. He didn’t go through it completely, sent me a half baked draft and when I showed him the missing clauses, he charged for that rework. 

Anyways, I am asking anyone to be a judge here. I am asking if there is any way to dispute this? Any channels?

Hi BP community,

I have a tenant who has been quite non cooperative and I had to get a lawyers help in sending the tenant a notice for rent increase and draft a lease and upload to digital signature site for signatures. 

For the notice and the phone calls around the notice with him, (which I expected to be covered in one price) he charged me almost $600 as he said he goes by hour.

so for lease I confirmed with him beforehand that he will charge me $200. Now, he has charged me almost $800 for the lease. Instead of $200 which should again cover all the conversation between him and I about the lease draft, just for the draft prep he charged $399. Then reworking $177 because he missed my initial comments. Then the rest for any phone calls back and forth around the lease again because he kept missing certain points from the lease draft. 

I fee this is extortion. Is there any way to dispute this?

Since we are on this topic and you both are so knowledgable in this area, I have one followup question. 

Other than changing filters, what other regular maintenance should be done with ac unit and at what frequency? 
Also, any special maintenance in area like arizona as well as in cold areas like washington.

Wow!! You guys Randy and John, thank you so much. Very much appreciate your inputs. Thank you for taking time to respond in details. 

Randy, you are correct. It's very hot in the area right now. I have a guy already setup to come and look at the issues. I am a remote landlord and I am noticing that my tenant is not keeping up with the regular maintenance in general. So wanted to get myself familiarize with issues that arise from a tenant negligence. I am not trying to go after a tenant to make them pay for this repair. I do want to be a responsible landlord but not visiting the property yourself make it challenging.

On my rental in the arizona area, I missed renewing the warranty which I was hoping would take care of the AC unit fixes. 

Now, the tenant has reported that the unit is working but its not cooling the place. 

I have asked an AC person to look at it. But I am concerned about the cost. 

A couple of questions, 

1. What AC problems can be caused due to poor handling by tenants? for ex. not changing filter regularly. Any other? Which types of AC costs can I ask the tenant to cover? (we do have a clause in the lease for regular upkeep of AC )

2. Almost all warranty wait period is 30 days. If I purchase the warranty, is there anything I can install temporarily during the wait time?

Hi Bjorn! thank you for the response. I spoke with them and they recommended an attorney but apparently so many attorneys I spoke with in WA area arent taking new clients. So I am stuck. 

If you have any other references, please do let me know. 

Hoping I hear from other members also. This forum is always a great great resource for any of my queries.
