@Scott Schultz I got the writ, but haven't executed it yet. The owner seems reasonable, but he did ask me how much time he has if he doesn't go through with the cash for keys deal.  I told him it would only give him an extra 3 days or so and reminded him in that scenario he would receive no money in moving. I get the feeling he might not leave on Friday when this is scheduled to happen and I may have to actually use the writ. I did put it in writing that he must be out at 9:00AM house swept of all personal belongings and all appliances, fixtures, plumbing in tact. 

@Jeff Cichocki I'm right outside of Milwaukee, I got the writ and brought it to the Sheriff's department and they said I'd have to hire one of the following moving companies and then come back(she gave me a list of 2 different ones Milwaukee county works with) Not really interested in paying them if I can avoid it...I'm sure my cash for keys deal will be cheaper. Milwaukee seems to make you jump through a bunch of dumb hoops...my experience with getting the writ was kind of a pain...I can only compare it to going to the DMV "fill out this form then go to that window"...."that form isn't correct, go back to the first window" etc etc

So I'm in Wisconsin and purchased a condo from the sheriff's auction.  The sale is final, I have a signed order from the judge, the redemption period is over, and I have a writ of assistance from the county to have the person removed.  I went and knocked on the door, told the owner what was happening and he would have to vacate.  Offered him a cash for keys option to just leave in 5 days.  He agreed to my offer, but I'm wondering if there is any other legal action/notice I have to serve him with to get him out if he welches on the cash for keys deal?  Do I have to give him any kind of notice to vacate in writing before I get the sheriff's team involved in the moving? This is not a huge project and my end of the day profit will be somewhere in the 10k range so I don't want to pay to consult with a lawyer.

Excuse me....didn't she just basically "fire" you as a customer? Eff off would be my answer.  You can't have your cake and eat it too! She literally did NOT want to work to sell your house anymore, but now she wants to get paid when you sold your own house!  She sounds outrageous and very immature, tell her to grow up.  I completely agree with @Andrew Goodwin....you will be weakening your position by giving anything when she is in the wrong.

@Scott Schultz It is Bass and Moglowsky.  The attorney from there told me to check ccap and it looks like it is 3 weeks from now. I'm not in a huge hurry and it wouldn't be the end of the world if it takes a little longer, but I was most concerned about the junior liens.  There seems to be a lot of back and forth on this website regarding that, thanks for the info though Scott.

Hey BP!
Anyone from SE Wisconsin been to Washington or Ozaukee County Sheriff's Sale? I've gone to the Milwaukee one several times, but the ones in Ozaukee and Washington just show like one or two listings each time...what's the experience like at these? Are there lots of people? Other listings not put on the county website? I feel like resale value would be a bit higher on some of these if you can catch a good deal.

It sounds like you needed some more research before bidding. 

 As far as the terms of the auction "THE PROPERTY WILL BE SOLD SUBJECT TO ALL LEGAL ENCUMBRANCES" and then it goes on to state how much is due at the time of sale, who pays for the transfer fee, and when the remaining balance is due.

There are no unpaid taxes.

So I've been going to the sheriff's sale for a while now and finally decided on a property I liked.  I did a title search online and came up with nothing, researched the neighborhood (it is very close to my own home) etc etc...anyhow, this morning went and placed my bid and WON! I felt pretty good about myself walking to the car. Now...I just got back to the office and started doing some research on what the next step is....I'm seeing some information online that says I could be waiting up to ONE YEAR if the home is occupied?? How can that be and is it true?

  That's the least of my worries because now I'm looking at the Sheriff's sale notice and I'm seeing several defendants...two of which are banks..one of the banks is Universal Savings(google search indicated they were out of business) and the other was Midland Funding(a CC debt collector) Am I going to be on the hook for those two secondary judgements? I thought if they weren't in first position they were dissolved in the foreclosure?
