Hi, Does anyone have a recent experience with regard to how many weeks out a jury based eviction trial is typically scheduled for in Orange County, CA? Just curious if it would be weeks or months of waiting before one is scheduled - if the tenant was to ask for one?

Hi All, Have a tenant who has been chronically behind on rent for some time, and served couple other 3 day notices in last couple months, to which he made partial payments, and as a result was behind bymore than half the rent as of last month, and so for this month after again being late by two weeks, he was served with another 3 day notice to pay in money-order only, which he finally replied to saying that his account was hacked back in early September and that bank had said his issues will be resolved in 90 days, which sounds like a stretch as the tenant also mis-represented on the application about his previous landlord reference, which was confirmed to be a lie, and has been problematic from day one.  The question is the following.  In this case, after the most recent 3 day notice, he again said that he can make full payment (for this month as well as previous balance), and so he was allowed to make a payment, but this time, the payment site was set not to accept any partial payments, and so now a week has gone by, and no payment, but have received an email from a supposed rent-assistance type of organization that states their intent to pay for him or something to that effect on the grounds for covids and/or financial hardships to avoid going homeless, which I am guessing is more of the same cat & mouse game to buy time. and here is the question: Given that he was offered a chance to pay online the full amount (which he didn't), does that invalidate the most recent 3 day notice, and if that means that we have to serve him yet with another fresh 3 day notice before proceeding with getting the lawyer to evict him?

Hi All,

Tenant (represented by an agent) wants to move in the day after application is submitted, stating that the landlord wants to raise rent. Not a week has gone by, and having issues, such as water damage, and not turning over the utilities, and generally being unresponsive. At this point, double-checking the referenced landlord on the application, the supposed landlord provides rosy feedback, but doesn't seem to know all the details about the property, which led me to check the title owner which seems to be someone else. If a misrepresentation has occurred here, Is this ground for eviction ? Also, what sort of liability/responsibility does the agent have in this situation?

I have an older condo rental in Dana Point where the tenant has been renewing on a yearly lease year after year.   Additionally, the lease does not offer any M2M option.    Just curious if the rent cap (5% + local CPI%) applies here when the lease is expired soon, where the tenants does not have a M2M option, and they choose to stay another year for renewal as usual?

Thanks all for the feedback.   Actually, I have done an inspection, however, it is after the fact, and with everything already seeming dry.   While anything is possible and a carpet cleaning job could potentially take multiple days to complete and involve large fan/towel/dehumidifiers, I would suspect it would be less probable it was just a routine carpet cleaning.  so thinking that my only clue as to what transpired would be what is scoped out in the workorder of the completed job.   

Hi All,    Big trucks with large fans & towels & dehumidifiers been seen at the rental, and tenant claims they hired carpet cleaners and staff to wash/clean all carpet&furniture.    Tenant is also not sharing the workorder/receipts so far to shed light on the scope of work that took place.  

From a landlord perspective, I obviously would want to know if there's been potential water damage that took placed.   Is the tenant required by law to share receipts of any work done on the house - if asked?

Would appreciate any feedback.
