Post: How to raise rent when in lease

I offered a 4 year lease which has 2 years left and now I’m trying to get out of it with the least of problems. The tenant is excellent, they pay on time and keep the house in a good condition, except that I suspect they recently added a 2nd dog when the lease agreement has only 1 dog. The current lease is $1330/month including the 1 dog rent and similar units are getting rented for up to $1600/month for a more renovated unit and a pet rent of $50/month per pet. The lease agreement has a mistake in its phrasing that could be void the contract. Although I still need to consult with an expert in contract laws but the contract can be voided for having 2 contradicting phrases. And I don’t have prove the tenant has 2 dogs, but I can have witnesses who saw them and social media stories. I’m not sure how to proceed. Any ideas how to be able to increase rent?

Hello, 

This tenant request to repair dishwasher is strange to me, and I need more opinions about this. Backstory: I lived in this house more than 2 years and I used to use the dishwasher almost everyday with no problem. 
the tenant text “Hi Ali! We have a bit of plumping issue or something going wrong. I’m not entirely sure. We never use the dishwasher. We always handwash our dishes and use the drying rack because the dishwasher never thoroughly washed the dishes when I originally moved in. Plus i prefer hand washing. When we got home this evening from work and daily activities we smelled this awful odor coming from the kitchen. We inspected and come to find out it was water piling up in the dishwasher. Angelica [the girlfriend] said that perhaps it could be the garbage disposable pipe? This water looked like it has been piling up for awhile. Could you have a plumper come out and look at it sometime over the weekend? Or early next week?”

My tenant wants to add someone for 3 months as a trial period, she says. I couldn't find anything online about this. Does anyone have an idea how to go about it?

Can you go after an occupant in court for damages?

They can either be a tenant who is financially responsible for the rent, any damages, etc, or they can be just an occupant who lives there at the tenants convenience. Since you have a tenant who has enough income to pay on their own, I would make it their choice how the 2nd person would be added.

The difference for you is that as an occupant you cannot go after that person in court.

The difference for the tenant is that if things don't work out, she can ask her girlfriend (occupant) to leave because she isn't a tenant and doesn't have the same rights. 

Either way, I would only bother to do a background check to check for criminal history because I already have a good paying tenant in place in the unit.

You can just add people to the lease. It doesn’t specify how to do something like that. The first is current tenant and the second is prospective. She’s been a good tenant paying on time and I checked the house after 1 month ago and it seems in a good condition and clean.

What does your lease say? If it says all adults have to be on the lease, then go with that. Is this a prospect or a current tenant looking to move someone in? If it's a prospect, it sounds fishy and I would just move on. If it's a current tenant, you have to determine your comfort level with bending the rules for said tenant. Is she otherwise a good tenant? If so, it's something to consider.

My tenant wants to add her girlfriend but she says. She says her girlfriend had bad credit because her mom added her to lease without knowing and failed to pay. For that reason, her girlfriend doesn't want to be added to lease. What would you do? This is in Montgomery County, MD.

I have seen this question before in BP, but the answers weren’t satisfying.

I screen potential tenants using SmartMove website by transunion. 

One applicant had been flagged with “invalid SSN”. How would you check that?

When you apply for an EIN with IRS, you can to choose what type of legal structure, business, or type of organization is being established. And LLC is one of the options.

Why would I pay someone (CPA or online tool) to form an LLC when I can do it by myself using the IRS website?
