Just purchased an occupied triplex in Indianapolis, IN. One of the tenants is not going to renew her lease at the start of the month and as such, has not signed any paperwork with me. The former owner/landlord has not transferred me her security deposit and is the one she has the lease with.

In Indiana, if she moves out on the 1st as she says, am I still required to give her a security deposit back? Even though I never received one from the former landlord/owner.

If I am being perfectly honest with myself, I do fully expect the GC to file at least Chapter 11 at this point so you're right but it looks like small claims court is only $55 to file.

Appreciate the reality check but not going to let him walk away scott free after handing my cell number out like candy.

Thank you! Sounds like I am going to have to file in small claims court against my GC to recoup. Can I seek anything other than fees I have to re-pay, attorney fees, and work that had to be redone due to poor workmanship?

What can I do in the future to prevent this?

No, my nightmare starts with SBS. I went through all my paperwork and the two subs who have contacted me are no where on anything that I signed with the lender or GC; one guy I've never even met.

I have switched to a new GC who is moving things along great at this point but is there anything that you would recommend I do to help mitigate potential costs?

I released my general contractor a few weeks ago for failing to stick to his timeline and today I have been contacted by two of his sub contractors asking me for payment. I told them that they needed to speak with him as I had my contract with him and he had been paid for work rendered. 

I know that he was having cash flow issues and already had not been paying his people on other projects (hence the previous delays; I wouldn't work for someone who wasn't paying me either). What steps should I take to protect myself?

Appreciate any and all help/advice!
