Eviction help in Cleveland ohio

Who is familiar with the current eviction process in Cleveland?

Trying to determine if my PM or I could be doing something else?

Squatter there for 2+ years.

No rent.

Presented a fake lease to my PM.

Allowed them to do an inspection.

Pays power but water /sewer are unpaid for 2 years & accruing in my name & they won’t shut off water to an “occupied” house.

My question: I’m being told

the city of Cleveland or the courts are requiring a “rental registration” before they will process the eviction.

Is this true?

What is the work around to this?

My squatter is savvy and knows how to prolong everything.

What else can I do to get him out or push the Eviction through Cleveland courts.

Attorney is Heyman Law office in Cincinnati.

Any insight is appreciated!

 I can recommend some more attorneys that could help. Also, do you have lead-based cert as they require in Cleveland? 

Did you just buy this property or have you had a squatter there for the last 2 years?

In reading your post, it sounds like you might have a police issue for trespassing, not a court issue with an eviction. I would bounce this off of a local R.E. attorney, it's worth a phone call. I can provide referrals if needed.

    Bought with a lease in place. That guy left overnight and squatter took over.

    Court wants a rental registration.

    City of Cleveland wants a certificate of occupancy before they’ll issue the RR.

    C of O is impossible to obtain with a squatter.

    Lead thing - wouldn’t that be done in escrow?

     I would speak to some more attorneys because this is a complex situation. Lead cert is different than a lead disclosure which you get at title.

    You have a trespasser with a fake lease, not a tenant. This is a complex situation-  I would go through an attorney.

     For starters, hire an attorney in Cleveland, not Cincinnati.

    For awhile they were not doing evictions if landlords didn't get their properties lead certified. Then landlords sued and they were no longer allowed to do that. If I recall I think the Cleveland housing court found another loophole to allow them to halt evictions on non lead certified properties by not allowing the owner to register them. It's a lot of back and fourth, but I am guessing the main issue you have is you didn't get your property lead certified ya?

     Housing court will treat this person as a normal tenant. This is not a Police issue.
