What action can I take?
Hi all,
I have a 7 year old, top floor condo unit listed for sale. The month after the realtor listed it, the tenant said there is water damage in the ceiling. I notified the property management company responsible for the building, and they said they would look at the roof and get it repaired. Two weeks later, nothing has been done and the water damage is now in the walls and seeping down. I called the property management company back, they said they're waiting on a lift to get to the roof. Following up, they no longer answer my calls. This will clearly be a long process.
Since I can't sell the unit in this condition for a reasonable amount, I am taking it off the market.
Is there anything I can do legally to speed up the repair process? It's not fair for my tenant to live in a destroyed place for an extended period. If I decrease rent for the time being to keep her there, can I charge that back somehow? I don't think I'd be able to get somebody else in there with the deteriorating condition of the place.
