This is the second time in this thread someone has stated to market the contract as opposed to the property. If I were you, I would consult an attorney and even speak with the real estate board in your area. First off, nobody buys a contract for a home, they need to see the home and the details first before making a decision to buy that contract - for the purchase of a home and this advice appears to me as a circumvention of the laws. Intent plays a huge role in case law so I don't believe this advice is valid, although I am not an attorney and I certainly do not know all the laws in all the states.
It is absolutely circumventing brokerage laws. When they sign a contract and bring an end buyer they are brokering regardless of the spin they put on it. Their purchase agreements are defacto listing agreements.
