Is it illegal to advertise REO w/o being purchased??

I was wondering if it was illegal to advertise REO properties to gain perspective buyers without having purchased property or put a bid in. Since you cant assign contract to REO property and there are no option to purchase either in my state. Im pretty sure it is but I was just wondering..
