Newbie: Putting a property under contract

Hey guys okay so I found a really good property in Upstate NY looking to put it under contract with the seller I have a general purchase and sale agreement contract and i wanted to know if that was alright it basically states I can assign the contract and I want to purchase. I spoke with an attorney and he was saying that he cant with clear conscience help us assign since we dont own the property but if we wanted to do an option to buy he would help. First ? is is my contract good enough to put this property under contract second should I do this as an option to buy instead of assignment whats wrong with putting it under contract and assigning it
