HELP: Problems with Inherited Property

I've got a deal where the seller and I are on pause until we hear back from our attorneys. He inherited the property from his deceased grandmother but the estate is currently in the public notice process(?) and wont be transferred to his name for another 3 weeks. Can I still have seller sign the contract if the closing date is after the deed will be in his name?
