HELP! Seller's name not on deed YET

I've got a deal in which the seller and I are on pause until we hear back from our attorneys. He inherited the property from his deceased grandmother but the estate wont be transferred for another 3 weeks. Can I still have seller sign the contract with a contingency that they must had the deed transferred before closing?
