Wholesale to a retail buyer?

I have a problem under contract for $85k, asking $95k to assign to a rehabber. I have rehabbers interested. I got an email responding to my Craigslist ad stating he was a cash buyer and was looking to live in it. My questions are:

-Could I tell the buyer that $95k is for investors and demand a higher price for retail?
-would i still assign the contract the same way if he was a cash buyer?
- is this legal to do so considering I don't have a RE license?
