Wholesaling an inherited property

A lead came through that is a seller of an inherited property. The seller states that she inherited the property from her brother. The terms that i've discussed with the seller would make a pretty great deal but when I pull the tax card I show that the brother is still the owner. What do I need to do to go under contract with the seller?

When you say wholesaling, do you really mean assigning? 

Wholesale is a term that relates to value whereas assigning is a strategy to transfer one's rights in a contract.
