Beginner wholesaling questions

Hey, I had a few questions:  

1. Is EMD required for the contract to the homeowner? Can I delete that from the agreement if I wanted to?

2. I called a title company to ask if they assign contracts and they asked who’s representing the buyer. I didn’t know how to answer this so I said "I was not sure I will find out". How should I have answered?

3. At what point do we ask the homeowner for pictures of the property? before locking up the contract or after?

    I’m not sure about your state, the minimum here is $10 earnest and option money. No one is representing the buyer. You ideally want to know the condition of the property before locking it up.
