Married with Two Primary/Main Residences?

Christa Jordan
Posted

I work in North Carolina, and want to buy a house there. My husband has his business and primary residence established in South Carolina. That house is in his name. I want to buy a single family home in NC and rent out the extra rooms to mid- to long-term roommates (house hacking). This NC house would be in my name. I will be spending four days a week, at a minimum, in this residence. I plan to establish residency in NC,  and could do that before buying a house as I am renting a place there now. My question is, can I have a primary residence separate from my husband's? We have filed jointly and separately, depending on which way our taxes are the lowest. We are happily married, not separating. Could the NC be my primary residence, or main residence, from a tax perspective even though my husband would maintain his primary residence in SC? Or, because we are married, are we treated as one entity with only one primary residence? Who would be able to advise me on this if the answer is complicated? Thanks in advance for the guidance.
