Commercial Arbitrage in South Carolina
Hello Legal geniuses!
We have a small arbitration company in South Carolina. We rent units to rent out as service accommodations. One of our buildings has a small commercial space below the residential units. We occupy all of the residential units upstairs currently. The owner has asked if we would take over this commercial unit as well with a 50% monthly rent term, meaning if its not occupied, we pay nothing, if we place a tenant then we get 50% commission of the rent. Question: can we do this without being a licensed property manager in SC. We are able to do it with residential but we are unsure about commercial and if it is legal to have a commission based rent arrangement?
