HELOC question regarding deceased spouse

I have a rental property that I own free and clear.  My husband passed 2 years ago, so he’s been removed from title, sonowh it’s solely in my name.

There's a HELOC on that property with no balance, but is in my husband's name only.


I’m just returned back to work from being off for the last 1.5 years due to recovering from surgeries, radiation, hospitalizations, etc. and I’m looking to catch up on my bills. 

Although I am not on the HELOC, could I get into trouble if I take a draw? I'm a little confused since all debt between married couples are shared.

We resided in CA at the time of his passing and I still live in CA.

Yes you could get in trouble, you need to notify the bank he is deceased and close the account.Then you could apply and get your own HELOC.
