Looking for a real estate attorney familar with TX Property Code & residential leases
Hi All,
I'm a new investor and just received a notice to vacate for victoms of family violance from my first tenants. Tenants seem pretty familiar with the TX Property Code and have submitted the paperwork called out to teminate lease. They've never been late and are asking that I use their security deposit as last month's rent. While it's a unfortunate situation, this being my first "challenge" with tenants, I'm curious to learn what options I have legally in regards to the security deposi. If I do accept it, how can I go about holding them accontable to cover any damages done to the property? On thing that raises a red flag is that the 3rd party Professional Documentation they submitted with their notice is dated in January 2023. Aside from them making a careless mistake, if this is the actual date, can they still leverage to get out of a year lease?
Hoping BP Members are willing to share some advise or any similar experiences they've had, and if anyone knows of a good attorney who's familiar in this area and is in Dallas, TX, help them expand their business and add a new investor to their list of clients :)
