Water Remediation Threatening Collections

Hello,

This is my first time posting. I recently purchased my first four unit building in Hermosa Beach.

Due to the rain back in January, we had a massive leak. I’ve dealt with water issues before including using water damage and remediation companies. They have all been great.

This company was referred to me by the leak expert. They also referred me to a public adjuster at the same time. They promised that this would be covered by insurance which we doubted based on our understanding of what is covered due to water intrusion.

They came in and ripped out our walls and ripped our floors. Barely put up containment areas up and they were not sealed. Stapled the plastic to the walls using large staples, causing damage. They left their equipment in our home for weeks on end and installed extra equipment that they didn’t use.  They also put a tarp on the roof, which didn’t fix the leak and charged us for that. I have photo documentation and videos of all of this.

At the end of the day insurance would not cover this and we had to pull the claim.

They are charging us for the full amount and I’ve been able to reduce it by about a 1/3 from $3000 to $1900. 

I know this is not a huge amount, but every penny counts right now. Also the principal of this and pain somebody was trying to rip us off as difficult. This company has an F with the Better Business Bureau less than two stars on yelp.

the best advice I got from an attorney friend is you never sue because you right you because you can win.

I’m curious if anybody here would suggest letting him send this to collections and fighting it or if it’s just a waste of time. Any and all advice is welcome.
