Unauthorized pets violation

Hello,

I own/occupy a duplex. Inherited upstairs tenants. Recently their dog died, i know this because i was the one who picked up the dog poop every week to cut the grass. They refused to take care of it. Now it sounds like they got a new kitten. This person is "disabled". So i have 2 questions. Am i exempt from fha esa laws? I will never be able to get photographic proof since they will never take it out of the apartment. Can i evict based on my own experience and maybe a sound clip?
