I am a remainderman living in life estate

Posted

This is a tad confusing, but I am hoping the explain and get some answers. My parents purchased a piece of property and placed a mobile home on the property in 2012 and I have been living on the property since 2013. The property was in both of my parents name and before I got married they put the property into a life estate where the property is currently showing me as the owner but I dont actually get the property until my mother passes away. I pay all the bills here, taxes, insurance and improvements on the property as well as rent to them. I know normally when a property is listed in a life estate that life tenant (my mother) is the person living in the home, but thats not the case here.
My dad is wanting to kick us out of the home so he can move the home to a different property. My mother does not want to do this and does not agree to it. SO my question is, can HE kick me out or evict me off the property? I cant seem to find any information pertaining to my situation.

Any help or information would be very helpful.

If you are paying rent to someone you'll never legitimately convince a court that you are the owner. It honestly sounds like you need the advice of an attorney here if you are intent on staying in the property. To be the lawful owner of a property means your name is on the deed of the property. If your name is not on the deed, you are not the owner even if you get tax bills and things like that sent to you in the mail. You can have "owner" stuff sent just about anywhere from the county registrar's office.
