Middle Unit Row House Property

Emanuel Rawlings
Posted

Hello, I am closing on a row house I purchased and I saw the deed for the first time yesterday. The property is the middle unit of a 3 unit structure. I am purchasing the unit in the middle but the 2 other units are owned by others. There is wording in the deed that states the sewer line and Gutters and Downspouts can't be obstructed and I am fine with that but there is also wording that says "Any and all repairs made upon said storm and sanitary system shall be born equally by the parties using the same". I believe that means any costs that we incur for repairs to the sewer system and gutters must be split 3 ways. If so, how does that work? Do we need to agree on any repairs made before they are made? Does one person pay the costs and bill the other 2 owners? I would appreciate feedback from anyone that has dealt with this situation or has seen this type of wording in a deed. Thanks.
