Building site and existing conditions with neighbors

I'm purchasing a vacant lot with municipal water/sewer available for a spec home.  The property is under contract with one caveat; The neighbor's sewer line runs across a portion of the property. (A family previously occupied 3 lots and this is the center lot)  I contacted the neighbor and discussed the issue and offered to provide an easement in exchange for a couple hundred dollars for the survey and they could piggyback on our closing attorney fees to resolve the issue.  2nd His driveway has apx 6x30 located on the lot as well.  I offered to sell him the driveway so that he did not lose it.  He decided it was not his problem.  

I have offered solutions and he does not want to play ball.  I'm concerned with selling the property after construction without the matter resolved.  I have a call in to my attorney but I'm afraid its Friday afternoon and I will not hear from him before Monday.  

How can I go about working with the neighbor or what legal documents should I be searching to CYA down the road?
