3 Family turns out to be legal 2 Family

I'm in the 10 day inspection phase of buying an owner occupied 3 family in New Haven CT. An inquiry to the city revealed it's a 2 Family. Has been rented as 3 and taxed as 3 as far back as we can tell (mid 80's). Everything is separate; utilities, heating etc for 3 units (one per floor) and zoning is multi-family. How hard would it be to get legal 3? Owner seems negotiable and seems willing to either reduce price or pursue legal 3 Family.
