2 decks required?

We have a 2 family that is an upper and lower unit. It currently has an upper and lower deck/front porch that will be completely torn off. We were wondering if you have to put the double decker porch back up? Can we save some $$ and just do a smaller single level porch in the front? Is that legally okay and would it hurt real sale?
