Married living separate refinance

Unsure how to approach refinancing my house.  I'm married but living separate for almost two years.  I live in a two family, my name is on the mortgage and my husband was taken off title in 2017.  My husband owns 2 single family houses.  He rents 1 house out and the one he lives in, he rents out his in law suite. I am not on the mortgages or titles of those homes. At this point all of our bank accounts and mail are separate, but we still file our taxes together.  The properties and rental income are reported on the schedule E. 

I would obviously want to refi as owner occupied with a convential loan to get rid of my PMI and cash out the equity so I can BRRRR. It's been 10 years since I was a loan officer and I'm not sure how the banks would view this. Court papers were filed for a separation, but like everything else delayed due to Covid-19.
