Termination of a Contract

Hi!

Made an offer on a property and placed Earnest Money with Escrow. In the meantime, decided not to close.

The Seller never provided a Residential Real Property Disclosure (Form 17), as per Chapter 64.06 RCW (https://app.leg.wa.gov/RCW/def...). The contract is now expired & the Seller wants to keep the EM. I believe the EM should be returned to me. I asked some Real Estate attorneys and got conflicting info.

Anybody knows if a RE contract is valid without a Seller's Disclosure or has a similar experience, before I lose even more money on attorney fees?
