FSBO and Condominium Purchase and Sale Agreement

I am selling my property FSBO and Form 28 "purchase and sale agreement" was supposed to be signed by 9/3/2016 9:00 P.M. by both parties. It was signed by buyer and seller on 9/3/2016 before 9:00 P.M. Turnouts Form 41C "Selling Firm's Commission" didn't get attached therefore it wasn't signed which makes the offer/agreement "unofficial" (according to buyers agent) until it was signed by seller on 9/5/2016. Question is, do I (seller) still have legal binding agreement with buyer/agent or can I walk away from the initial purchase and sale agreement?
