Encroachment on land

I am one of the owner of land in Europe. We want to sell the land but one lot has an encroachment on it. The owner of this encroachment is willing to buy it from us.  Some of us want to sell the land as is. I would like to get the encroachment settled first. The owner is willing to pay for surveying, legal costs and everything.  We would not have to pay a cent. I don't think anyone would be interested in buying land with this issue. What should we do?
