Mandatory Oklahoma Renters Insurance?
Purchased rental property in Oklahoma. Want to require renters insurance from my tenants for obvious reasons. I have done some research online and I am finding online sources that say OK does not allow you to require insurance? Yet OK law seems to say otherwise?
"The fire insurer is not entitled, as subrogee, to bring an action against the tenant to recover for amounts paid to the landlord for fire damage to rental premises caused by the tenant’s negligence in absence of express agreement between the landlord and tenant to the contrary. Landlord and tenant are co-insureds under the fire policy. Sutton v. Jondahl, 532 P.2d 478 (Okla. App. 1975) (known as the “Sutton Rule”)."
When I myself was a renter I specifically remember landlords requiring renters insurance which I was totally ok with and the above seems to confirm that. Just wanted some quick clarification if anyone has an answer. Thanks in advance for any help.
