Verification of senior lien status

Hello everyone, I am in the process of purchasing a non-performing 2nd position note and wanted to get a credit report on the borrower to help determine if the senior lien is current.  Is it permissible to obtain a credit report on a borrower without first getting their consent?  If so, any recommendations on where?  If not, any other recommendations for verifying the status of the senior line?  Any help would be much appreciated!  Thanks
