Does unrecorded AOM have legal standing?
Hello friends!
I am prospecting a note, and one of the things that concerns me is that one of the AOMs in the chain is properly executed but not recorded with the county. Hence the question - should the events turn the wrong way, would that be considered a "break in the chain"?

Alex, if you were to buy the note, you will receive an AOM to your entity. At that time you can record the entire chain (including the one unrecorded AOM). It may make sense to consult with an attorney to assist you to ensure they are recorded in the correct order (or use a firm such as Richmond Monroe or others)
