Help! Freddy mac- title issues ...

I'm in contract to purchase a property in Ohio through Freddy mac. We have been waiting and working on getting to closing but have been held up waiting on a clear title. We have signed several extensions. It has been 2 months, and I was just informed that Freddy Mac listed the house before they legally owned due to tax liens they are trying to clear. They are dropping our contract and will put the house back on the market once the lien is cleared. Don't they have a legal responsibility to sell it to me since we are in contract and the delay is on their side?... I'm very angry and frustrated. After all the work, money and time, they are just dropping our contract saying, "we will send you back your earnest money." Can they do this? Should I sue them? Has this every happened to anyone else? We performed all the duties on our end and have the money waiting go! What is a good way to proceed? Thanks a million

Tim
