Assignment And Allonge Chain Do Not Match
We had this post in our FB group and I wanted to share it with others as this is a common occurrence.
A mortgage was sold from Company A to Company B to Company C to Company D. There is the recorded assignment chain in order through these four companies.
The allonge chain goes from Company A to Company D - and Company D is in possession of the original note.
The question was whether this was problematic. I am NOT an attorney, but have had this occur in numerous situations and the answer has always been "not a problem"
There could be many reasons why this occurred, the most common is the allonge was actually endorsed to BLANK (not endorsed) and Company D did the smart thing and signed it to their company. There have been instances where an allonge may have been lost which the company was not around so the lender found the old company to issue a new document.
Moral of story, you need to have complete chains but they may not necessarily be chains that match when it comes to the mortgage and note.
