Seller did not provide all condo documentation- breach?
Hello- First time home buyer. About to close on a condo in 2 weeks. Signed P+S a few weeks ago. The site plan we were provided in the deed/condo docs shows we have 2 deeded parking spots in the driveway.
There were some questions around the parking situation (on our end) and we just found out that the seller's realtor did not provide the site plan for the latest amendment, which shows 1 large deeded spot. As part of our mortgage contingency it states that the seller must provide all the necessary documents prior to P+S.
We were pressured by the seller to review the deed/site plan etc. in a matter of 3 days due to them accepting our early offer (although they added additional pressure by leaving the property on the market).
The new site plan was just shared with us and shows the 1 large spot. Our question is, do we have any legal power at this point to say that the sellers are in breach (as they did not provide all necessary documents), and if so, are we able to get any credit to be used towards our closing costs, fees, etc? If so, how much? We agreed to a 740k sale price and are expecting about 6-7k in closing costs. Any help would be greatly appreciated.
