Subject-to offer via MLS?
Hi, has anyone successfully gotten a subject-to offer made/accepted on an MLS property with realtors in the mix?
I would imagine pushback from the seller's agent and no ability to explain to the owner what it means.

That is hard to do. When an agent has an agreement with a seller you need to be mindful of the agreement and commission. If you found the property through the MLS you owe the commission since you wouldn't have known about the property otherwise. Also, an agent has a fiduciary responsibility to the seller and a Subject To is risky for a seller. Why would any sane agent risk a lawsuit by recommending a Subject To transaction and how would the agent get paid? I stay away from the MLS when doing Subject To's because of those facts. "Off Market" Subject To's are so much more profitable than potential MLS Subject To's that it doesn't even occur to me to use an agent or the MLS.
