Subject-To after divorce (Mortgage Responsibility)
In the process of acquiring a property Subject-To that has recently see the wife & husband go through a divorce. House was awarded to the wife and she is getting the "Warranty Deed" transferred in her name only. What happens to the Mortgage? do both of their names stay on it? Is there a way to get his name off it without setting off "Due on sale clause"?
I don't want the ex-husband getting upset and blowing everything up. Thanks!
