Hard Money Lending - Advertising/Marketing

Hi All -

I do some hard money lending in Texas and a realtor in Texas just told me that I cannot use the word "lender” or "investment" on my business cards. The realtor also mentioned that I cannot collect date of birth, SS#, source of income, bank statements, tax returns or credit reports from a borrower as part of my qualification process because I am not licensed. For clarification I only fund 5 loans in a consecutive 12-month period and none of them are homesteads or owner occupied.

This doesn't sound correct to me so any and all information/feedback would be greatly appreciated.
