Ohio LLC, living in CA

Posted

Hi all, new here and I see this has been discussed before but it's been a few years. I've recently formed an Ohio 2 member LLC (my husband and I) for a SFR I'm closing on next month. I live in CA. I understand I'll need to file in CA with the FTB as a foreign LLC and pay the $800 whether or not the LLC makes money. It appears in Ohio the LLC must have gross receipts of $150,000 to file the CAT and pay $150 (so thinking I need to do nothing in Ohio since annual rents will be well under).

So my question is do I need to file a state return in each state on behalf of the LLC? It is 2 member (my husband and I, therefore it's a pass through entity). Then my next question is do I need to file a personal return in Ohio since the income is taxed on a pass through basis? Or am I way over thinking this?

Thanks for your help here. I know a lot of you have similar situations. Happy to network and provide any guidance I can also.

Leslie-  It sounds like you are on the right track but before you finalize anything, I would recommend that you speak with a qualified tax professional or CPA.  You may get one on BP to chime in or I could refer you to a couple guys.
On a related but separate note, don't forget that many cities in Ohio also have a tax which requires a LLC to file a return.
