4 family building in Elizabeth NJ
Hello, I am purchasing a 4 family building in Elizabeth NJ in which i am planning to move in to after closing. I Have a attorney who is not helping at all I am here hoping someone points me to the right directio.
so here is the problem
1 the owner and seller attorney is not sending out notice to tenants to move.
2 we need two apartments to move in but the tenants are are asking for $12,000 each unit they said we have to pay all 4 units to move or no one is going to move. I am willing to pay two units they won't accept unless its all 4 units the tenants are all family living in different units with expired month to month lease
In this situation what can I do?
3. Made a mistake hiring attorney who only deals with closing and not eviction and she is not helping.?
4. I already made deposit for the closing In this case can i sue the seller and the real estate agent to comply they are not helping att all.
Will I get my closing deposit back its been over 3 months?

The fact they are month to month is a great benefit for you.
The first scenario is to file for non payment eviction and the New Jersey Court systems.
The second scenarios to hire another lawyer that knows what they're doing and specializes in just real estate transactions. It sounds like your attorney might either be too busy or in experience in this field. If the contract has not stated for that the writer did not specify the letters should be sent out or that there is a contingency with literally going to the tenants you might have to wait until after closing to do with the tenant.
The third scenario is that you can pay the tennis to leave and have them sign an-agreement. Once they vacate the premise is as per the terms of the agreement that you both agreed to they give you the keys to get the cash.
The fourth scenario is that you can hire a real estate agent to help find them a place of residence. With this scenario you have to put a time limit so that way they don't say I don't like this place and string you. This option is a means of an option and should be rarely used.
You should asses the situation and see which one of the above scenario Works best
