Stop sale on home in trust
Hi there. Im writing in concern to my grandparents trust regarding how the estate is being handled. My Grandparents had 8 children, 2 of whom are passed on, one of the deceased is my mother, which makes my sister and I beneficiaries.
There are two properties involved in the estate. One that was the primary residence of my grandparents as well the youngest sibling who has some special needs. That property is located on three connecting lots in an area of pretty prime real estate. There is another townhome about a mile away that is also prime location but is a rental. What I’m concerned about is the first one as it was sold and I don’t think it was done legally. In the will it states clearly that the youngest sibling with special needs is to remain in the first property until he wishes to leave or he passes away and then the property is to be sold and divided equally amongst the 8 children. He did not want to leave and he hasn’t passed away. The two siblings that were appointed executors, only because the will was done in a workshop and it simply suggested the oldest boy and the oldest girl be appointed those positions not because of their experience or knowledge in this field. These two siblings retired early and now need more money to support their lifestyle. Without consent or even consulting all of the beneficiaries, they sold the first property for what many have agreed was way under market value and not enough time to reach a fair price. My main issue is with the youngest sibling being relocated against his wishes, they even changed his phone number and have moved him into their home to keep him quiet, and I think gnat the sale of this home was done illegally. There was no probate. We have asked for financial statements of some sort and were bullied and scared away from asking asking again. Is there anything I can do to stop this sale and mismanagement of this estate before they entirely screw all of it up and my uncle is just thrown away without regard ?
