529 savings plan in NY

folks - it's unclear after the federal rules changed and now allow 529 to be used for daycare/preschool and if NYS allows it - they haven't ruled in this regard and a local school told me that till they rule, I cannot use the plan for preschool. Does anybody have more info on this
