HOA and brick wall

bought a house in a cuddlesack in 09 the entire neighborhood is emcopassedin a brick wall, front and sides, my wall is both front and sides ,told by the seller wall covered-my bad

Nothing about fence/wall in HOA book bylaws or covenants

I noticed structral damage on wing wall contacted HOA June 2012, they said nothing in book, I joined the board, and they took resposibilty/used HOA money to find out, got survey, lawyer, determined my wing wall was deemed on 50/50 land and that the HOA never deeded that land over via quick title. More meetings, no decisions for 2 years. Now the outside of the wing wall has fell and caused my portion to severly lean, and now they say it's ALL my resposibility, even though they told everyone else that their wall was their wall and my wall is 50/50.

My Insurance does not cause pay for structural damage,claim denied.

Am I screwed?

if so can i go back with anything or do I have to see if there is a city code? (read a story)

HOA book says Buildings and improvement in good order and repair, Also since the wall is brick and ties into 2 different properties, whats the deal? what if I tore it all down and was didn't do brick? put up siding and rented the house?

Thinking I should email HOA president and demand he needs to facilitate a meeting for all concerned parties to come to an agreement, and possibly contact legal counsel?

62 homes in here, 26 homes located on the side wall, and 6 located at the entrance wall.
